Our family law attorneys have over thirty five years of combined marital property dispute experience. We understand the complex issues involved in distributing marital property. Our extensive experience with marital property disputes includes the following:

  • Classification Issues - including whether the property or asset in question is "marital property". In Minnesota, it is assumed that all property is marital property and the burden of showing that a particular asset is not marital property is on the party making that claim. Also, Minnesota family law courts will generally not consider any funds that are commingled with marital funds to be non-marital property.
  • Valuation Issues - this is one of the trickiest areas in family law, and includes issues with valuing professional businesses (doctors, lawyers, accountants, engineers, etc.), as well as valuing wholly owned companies, minority shares in small corporations, stocks, pension plans, stock options, inheritances, etc.
  • Valuation Date Issues - another tricky area where the issue is when the valuation should take place on a particular asset. For example, should it be at the first hearing? At the time of separation? Or some other time? It is not difficult to see that time can dramatically change the value of an asset.
  • Hiding Assets - another issue that sometimes comes up, either during the divorce, or subsequent to the divorce is a spouse who has hidden assets.
